Islamabad: (Web Desk) Federal Law Minister Azam Nazeer Tarrar has presented the Practice and Procedure Bill 2023 related to judicial reforms in the National Assembly.
According to the bill, the powers of suo motu notices will be regulated and it has been proposed that the three most senior judges of the Supreme Court will make decisions on suo motu notices, with the right to appeal within 30 days of the decision.
The bill also proposes that a hearing should be scheduled within 14 days of the appeal being filed, and that a three-member bench should hear the case after taking suo motu notice.
The majority decision in this regard will be acceptable, and after the passage of the law, no decision of the Supreme Court or High Court or any other law can have an impact on it.
The process of legislation is underway in the National Assembly, during which Federal Law Minister Minister Azam Nazeer Tarrar presented the bill related to judicial reforms, saying that we have also seen in the past that suo motu notices were taken due to the lack of parking facilities in hospitals, and there is a lot of criticism on suo motu notices.
Minister Azam Nazeer Tarrar said that the power of suo motu notices is currently in the hands of the Chief Justice under the current rules of the Supreme Court, and in the past, individuals have used this power in such a way that it has caused damage to institutions. In 2018, the Bar Council said that Parliament should consider this issue and how benches should be formed.
The federal law minister said that there have been many injustices with the people, and if a decision comes from the Supreme Court, there should also be an appeal in the inter-court. In the past, no one was held accountable for the misuse of the power of suo motu notices.
